1. PREAMBLE :
The present conditions apply to all reservations (hotel, spa and event) made with SAS GARENNES CENTER, operator of the spa hotel Le Château Les Garennes in Clohars-Fouesnant. They cannot be used for reservations made through a reseller of SAS GARENNES CENTER (Booking.com, Expedia, Staycation) except for points 5 – 6 – 7 – 8 – 9 and 10, which are valid for all customers staying in the establishment.
For reservations made through a SAS GARENNES CENTER reseller, please refer to the reseller’s General Terms and Conditions of Sale. The customer declares that he/she has full legal capacity to enter into the present terms and conditions. The customer’s agreement to the general terms and conditions of sale and the terms and conditions of sale of the fare booked is obtained at the time of booking; no booking is possible without this agreement. Customers can save and edit these terms and conditions using the standard functions of their browser or computer.
2. RATES AND RESERVATIONS :
Reservations become final only on receipt of the deposit paid for the service. The amount of the deposit varies according to the service offered.
No reservation can be taken into account without payment of a deposit or communication of the unique code of a gift voucher.
Reservations cannot be taken into account without a credit card number and its validity date (it is specified that the credit card used must be valid at the time of the stay) and the visual cryptogram.
Reservations cannot be taken into account without a valid e-mail address. The latter is used to communicate the details of the reservation and the General Sales Conditions relating to the reservation.
Our prices are quoted in euros. VAT is always included. The prices indicated include only the services strictly mentioned in the reservation. Any additional services provided by the hotelier during the stay and, where applicable, the tourist tax will be added to the price mentioned in the reservation.
The prices applicable are those in force on the day of booking. As independent professionals, hoteliers are free to vary their prices at any time. Therefore, the price displayed during a visit to our website is only valid for orders taken during the period in which it is displayed. Only the price indicated in the booking confirmation is binding.
3. BOOKING CONDITIONS :
A. General terms and conditions
Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
A deposit of €100 per night and per room is required. When booking a massage, spa access or brunch, the full price will be charged.
A bank authorization request may be made on your credit card. The amount cannot exceed the amount shown on your confirmation. The authorization request is not an immediate debit, but corresponds to a reserve for future payment, authorized by the customer’s bank, which temporarily reduces the ceiling of the bank card used to guarantee the possibility of a future debit. In some cases, however, the authorization request may appear as a pending debit on the bank account associated with the card used. A bank pre-authorization will be carried out on our payment terminal if we lend you bathrobes and towels at the spa. If you fail to return them, we will be obliged to charge you €50.
B. Special case of “gift voucher” bookings.
Holders of a hotel or spa gift voucher must quote the unique code shown on their voucher at the time of booking.
The services ordered by means of a card will be those mentioned on the said gift voucher.
Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
In the case of a reservation with a valuable gift voucher, and if the value of the gift voucher is not fully used during the stay, the customer will not be entitled to a refund of the balance. The remainder remains valid for future services until the end of the gift voucher’s validity.
4. CANCELLATION AND MODIFICATION CONDITIONS :
A. General terms and conditions
For accommodation services (reservation of rooms in an establishment or other types of accommodation), customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, and this in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts relating to the provision of accommodation services which must be supplied on a specific date or at a specific time.
Prices may be revised upwards in the event of a request to change the dates of stay, or the type or quality of service. The deposit will be applied to the new reservation. In the event of an increase in the initial price, an additional deposit will be charged. Any request for modification must be made in writing (e-mail or post). Any modification is deemed valid only after written agreement from the establishment.
Cancellation policy :
- Hotel: non-refundable within 72 hours.
- Massage or spa access: non-refundable within 24 hours.
- Brunch: non-refundable within 7 days.
All cancellation requests must be made in writing (e-mail or post). The date of the request (date of e-mail or postmark) will be used to calculate the cancellation period.
In the event of a no-show, the total cost of the accommodation will be deducted from the card provided at the time of booking, less any deposit paid.
In the event of interruption of the service due to the customer’s fault (e.g. early departure), the full agreed price will be collected.
Reservations for services may be modified or cancelled directly with the establishment, whose contact details, including telephone number, are specified on the reservation confirmation sent by e-mail.
B. Special offers (promotions, discovery offers)
For accommodation services (reservation of rooms in an establishment or other types of accommodation), customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, and this in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts relating to the provision of accommodation services which must be supplied on a specific date or at a specific time.
Irrespective of the cancellation period, all sums paid are non-refundable.
In the event of interruption of the service due to the customer’s fault (e.g. early departure), in the case of reservations with prepayment before the stay, no refund will be granted.
C. Special case of “gift voucher” bookings.
For accommodation services (reservation of rooms in an establishment or other types of accommodation), customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, and this in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts relating to the provision of accommodation services which must be supplied on a specific date or at a specific time.
Room cancellation :
- Cancellation more than 72 hours before arrival and the gift voucher’s validity date is later than the date of stay: no charge and the gift voucher remains valid until its validity date.
- Cancellation more than 72 hours before arrival but the gift voucher’s validity date is prior to the date of stay: the services included in the gift voucher will be billed. The value and use of the gift voucher are lost.
- Cancellation less than 72 hours before arrival: the services included in the gift voucher will be charged. The value and use of the gift voucher are lost.
Please note that the information given above is not valid for spa or brunch gift vouchers: the cancellation conditions for the latter are firm (see General conditions: Cancellation periods).
In the event of a no-show, the services included in the gift voucher will be forfeited by the hotel, and any additional services or the balance of the stay provided at the time of booking will be charged to the credit card provided.
If the service is interrupted due to the customer’s fault (e.g. early departure), the services included in the gift voucher will be forfeited to the hotel, and any additional services or the balance of the stay will be charged to the credit card provided at the time of booking.
D. Force majeure
Force majeure refers to any event external to the parties that is both unforeseeable and insurmountable, preventing either the customer or the hotelier from fulfilling all or part of their obligations under the contract. This applies in particular in the event of strike, insurrection, riot, or prohibitions imposed by governmental or public authorities.
It is expressly agreed that force majeure suspends the parties’ performance of their mutual obligations, and that each party shall bear the costs arising therefrom. In particular, customers are solely responsible for any additional costs that may be incurred to enable the trip to continue, following the occurrence of a case of force majeure.
Any deposit paid at the time of booking will be retained and may be used for a new service within a maximum period of 18 months.
In the event of force majeure or any other exceptional event that prevents the service from being provided, and in particular the reserved room in the establishment from being made available to the customer, the establishment may reserve the right to accommodate the customer, in whole or in part, in an establishment of an equivalent category, or to provide a service of the same nature, subject to the customer’s prior agreement.
5. ANIMALS :
Small pets (under 15kg) are accepted at the hotel (with a surcharge of €15/night), provided they are kept on a leash in and around the premises. Access to the spa is forbidden.
The hotel reserves the right to refuse access to its premises to guests who fail to meet this criterion, and may apply the cancellation conditions relating to no-shows.
6. LIVING ROOMS AND BEDROOMS :
In application of the regulations in force in certain countries, the customer may be asked to complete a police form on arrival at the hotel. To do this, customers will be asked to show proof of identity to verify whether or not they need to complete the police form.
The customer accepts and undertakes to use the room with due care. Any behavior contrary to public decency and order will lead the hotelier to ask the customer to leave the establishment without any compensation or refund if payment has already been made. If no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment.
Rooms are available from 3:30 pm on the day of arrival and must be vacated by 11:00 am on the day of departure.
The entire establishment is non-smoking. Customers are asked to respect this rule, particularly in bedrooms. In the event of failure to comply with this rule, a flat-rate charge of €300 will be debited from the credit card provided at the time of booking.
In the event of damage to furniture or theft, the establishment reserves the right to debit a fixed amount of €500 from the credit card provided at the time of booking.
The hotel offers WIFI access, enabling guests to connect to the Internet free of charge. The customer undertakes not to use the computer resources made available by the hotel in any way whatsoever for the purposes of reproducing, representing, making available or communicating to the public works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the French Intellectual Property Code, where such authorization is required. Should the customer fail to comply with these obligations, he or she may be charged with counterfeiting (article L.335-3 of the French Intellectual Property Code), punishable by a fine of 300,000 euros and three years’ imprisonment. The customer is also obliged to comply with the security policy of the hotel’s Internet service provider, including the rules governing the use of security measures implemented to prevent the unlawful use of IT resources, and to refrain from any action that undermines the effectiveness of these measures.
7. PRIVATE ACCESS :
Access to certain parts of the facility may be restricted. The information is indicated in front of each space concerned.
8. MOVING :
In the event of exceptional circumstances or the impossibility of making the reserved room available to the customer, or in the event of force majeure, the establishment reserves the right to accommodate the customer in whole or in part in a hotel of an equivalent category, for services of the same nature and subject to the prior agreement of the customer.
9. FORGOTTEN PERSONAL EFFECTS :
If personal belongings are forgotten, the customer must send a complaint e-mail. Shipping costs are at the customer’s expense.
SAS Garennes Center reserves the right to keep unclaimed lost and found for 1 year.
10. CLAIMS :
Complaints relating to the non-performance or poor performance of hotel services must, to facilitate their processing, be brought to the attention of SAS GARENNES CENTER in writing within eight days after the date of departure from the hotel or spa directly to the establishment or to the contact details below. In the absence of a satisfactory response, or in the absence of a response within 60 days, the customer may refer the matter free of charge to the Tourism and Travel Ombudsman: www.mtv.travel.
